@Theo_III No thanks. When I was first dipping my toe into aviation YouTube I watched maybe a half dozen of his videos. I got a general impression that something wasn’t right with him and he seemed to be involved with an inordinate amount of drama. If I want drama I’ll watch a movie or TV show. Someone who is entangled in a lot of controversy might be exercising poor judgement. They might be drama queens/instigators. They might be extremely unlucky and prone to stepping on rakes. I don’t know. I do know that it bores me rather quickly. I guess that’s the bottom line. If you’re a disinterested 3rd party, the trials and tribulations of Dan Gryder are boring.

Big thanks to Greg Reigal for explaining the legal nuts and bolts of the Jacob case. I wish they had delved deeper into the false statements issue. We don’t know for sure what Trevor Jacob said to the FAA, but I bet anyone a dozen donuts that he misrepresented the events surrounding the crash when he reported the crash.

@trnguy6137 How so? Maybe you’re referring to a very few high profile cases and basing your opinion on the outcomes of those cases? There are hundreds of thousands (if not millions) of civil and criminal cases decided every year. Have you done any sort of analysis of all these cases to come to any conclusions of whether justice is being done or not done? I think that you don’t know what you’re talking about. Maybe you’ve formed an opinion based on very little evidence, maybe you’re just repeating B.S. you’ve been told on social media, maybe you’re just trolling. Whatever the case, you’re out of your depth, Donny.

That’s a good question. Unfortunately, there are a lot of unanswered questions with regard to the helicopter company. We don’t even know for a fact that the wreckage was removed from the crash site. I know people have done fly overs, looking for the wreckage, but not finding it from the air isn’t proof that it was removed. Proof would require finding the crash site on foot and verifying that the wreckage was not present. Even if we can determine for certain that it was removed, we don’t know who had it removed nor do we know who has possession of the wreck. It could be sitting in a small warehouse rented for the investigation as we speak. We just don’t know.

Let’s give the LAPD their due. Bottom line: No bystanders were shot by the responding officers. Hopefully this represents much needed policy changes and we can look forward to more police responses that don’t injure or kill innocent bystanders.

Exactly correct. I’ve read different opinions from people familiar with the guideline point system that suggest he’ll get less than 24 months. One opinion was that he would not get any prison time, but house arrest and supervised release. I’m not one of those that thinks he should do 20 years. If 2 years is the upper limit, he should do 2 years. That sounds like a reasonable and proportional punishment. What troubles me are those Trevor supporters who think obstruction of justice is no big deal. Their main argument is “nobody was hurt, so no real crime was committed”. The thing about obstruction is that it hurts everyone when the rule of law is circumvented. I don’t know why that is so hard for some people to understand.

@TakingOff Here’s some questions I would ask if you get a second bite at the aviation lawyer apple: What sort of false statements might Trevor have made in a case like this? Would his initial report of the crash to the FAA constitute a false statement? Would the FAA allow him to amend his report if he omitted any facts? What might happen if the FAA allowed him to remove the plane from the crash site based on false statements about the crash? I think that the issue of false statements to a federal agency is the more serious threat to Jacob. Losing your ppl and paying civil fines is nothing compared to prison.

Very common to not have signal in the mountains. However, you make an interesting point about conserving battery—for when he DID find some signal. I would not be surprised if he had cached water and a first aid kit near where he planned to land.

@Zlee533 I’d be super interested in seeing an interview of whoever was his flight instructor. They’d hopefully get asked if gliding approaches/emergency landings were part of the training, or if they trained him to jump from the plane at the first sign of a problem. Was strapping fire extinguishers to his legs part of the training? Questions like that. I also want to see who he hires to defend him when he has his FAA hearing and/or if any county/state/federal criminal charges are brought against him. I suspect he’s got a rich mommy and daddy. Poor or middle class kids generally don’t become Olympic snowboarders. That’s a sport for the well-off.

I disagree. He’s lawyered up and he’s listening to his lawyer. The proof is that he did shut up completely as soon as the FAA announced their investigation into the crash. I’m not saying it’s easy for a loud mouthed self-aggrandizing attention seeking twerp to shut up, but he has very serious potential charges hanging over him. I suspect Trevor is a rich kid, and I don’t think this is the first time he’s had to hire a defense attorney. His lifestyle screams “I’m from a wealthy family that gives me money but very little love and attention”. Another of his videos claims he was arrested for illegally riding freight trains. I also think he’s been to rehab and/or a 12-step program. I base this opinion on his talk of being protected by his “higher power”, which is AA terminology. It might be interesting to see if Trevor has had any DUIs and if he got a diversion rehab. For the record, I hope you’re right that he does start representing himself pro se in the court of public opinion.

The FAA did not rule or make a final disposition of the case. The FAA letter is an emergency revocation to stop Jacob from flying immediately, as he is a danger to the public.

I’m not a lawyer. I think it’s pretty clear that he lawyered up relatively quickly. It’s hard to imagine why a blowhard like Trevor would suddenly clam up unless he was taking legal advice. If I was plotting a legal strategy, the biggest potential threat would be the criminal charge of making false statements to the FAA. As Lawyer Greg pointed out, potential consequences are up to 5 years in prison and up to $250,000 fine. So I’d want my client to come clean to the FAA immediately by amending the report and taking my lumps from an administrative judge—revocation of the PPL and fines for FAR violations. That done, perhaps there would be no false statement charges. If there are, you try to plead those down to avoid or minimize prison and minimize the financial penalties. Trevor might be able to avoid prison by pleading guilty by reason of idiocy while his advocate is also pushing hard on “no harm, no foul”.

Those would be state charges. I wish Lawyer Greg had gotten into that, but I don’t think he practices in California and probably was hesitant to comment on an area outside his expertise. Instead he got sidetracked by the question about civil claims.

That would be pretty messed up. Maybe you’re suggesting that Trevor Jacob is a closeted gay and would have a relationship while in prison. I don’t know if he’s really gay, but it wouldn’t surprise me.

As I understand it, there will be two hearings. The first is the change of plea. The second will be the determination of the punishment. What I would like to know is if it’s possible to file an amicus brief for the penalty phase. I would argue that there is an extenuating circumstance for a stiffer penalty: to send a message to other morons that would risk people’s well being for YouTube views.

It’s possible. It’s also possible that the FAA retrieved the aircraft, not Jacob. It’s possible that he retrieved it, but that the FAA is in possession. However, I’ll put this out there: if the FAA released the wreckage based on false statements made by Trevor Jacob, that brings up the question of spoliation of evidence. If that’s the case, that’s more potential criminal charges.

The crew safety complaint had to do with short turn around/long days and having to drive an hour home on dark mountain roads. The production had promised hotel rooms and reneged. The D.P. (the one later killed) had tried to negotiate on behalf of her crew, even bargaining away rental equipment (I think a crane) so production could stay in budget. I think concerns were expressed about the A.D., but that had nothing to do with the camera department walking. If you’ve worked on low budget productions as I have, you know just how sloppy some producers are, how much they cut corners, and in some cases, how they cheat their crew. You might also know the difference between the good type of control freak AD that keeps things moving, and the type that pushes the crew too hard, safety be damned. Maybe you’ve heard this old joke about producers: Two producers are walking down the street and they walk by a beautiful woman. After they pass, one says, “I’d like to screw her!” To which the other replies, “Out of what?”

If you’re referring to luck running in threes, I’m afraid you miscounted. He survived the air crash, he survived the train crashing into his downed plane, and the LAPD didn’t shoot him after pulling him from the wreckage. And while we (rightfully) praise the responding officers for saving the pilot’s life, I think we should also give props to the LAPD for not accidentally shooting any bystanders. I really did not think they would get the new policy implemented so quickly.

Not just conceal. He destroyed the evidence, and he did so in a manner that showed premeditation and planning. There’s even an argument that he formed a conspiracy to obstruct an investigation, because he got two other people to participate in his cover up. Conspiracy to commit obstruction is even more serious than the charges he is facing.

It wasn’t allowed. But it somehow got there and somehow a single round got loaded into the chamber. Apparently the workplace rules were infringing on someone’s second amendment rights, so that person did what any patriotic American would do and did whatever the fsuck they wanted without regard to anyone’s safety. But even still, however real ammunition got on set, that was just one point of failure among many, any one of which would have prevented the killing.

It’s possible. The current case is obstruction and doesn’t touch on the underlying crimes. The state could go after him without violating double jeopardy rules. In addition, I don’t think the FAA has reached a final determination of his civil penalties in addition to any fines imposed by the court.

@CreamyPesto505 I need to type something in all caps for emphasis because something is not getting through to you. TREVOR DESTROYED EVIDENCE. That’s a big effin’ deal and a serious crime. This is even worse than lying to investigators, which is also serious. Furthermore, his destruction of evidence was premeditated. He had to charter a helicopter, enlist a friend to help. He then chopped up the wreckage and went to some effort to conceal that he was disposing of it. This isn’t a spur of the moment bad decision like “accidentally” losing a document. He’s lucky they aren’t charging him with conspiracy to obstruct, because he roped other people into his scheme. And lucky for them, they aren’t being charged as accessories or co-conspirators. When you obstruct an investigation, it hurts everyone. This isn’t a victimless crime.

He didn’t crash it into the Condor refuge. The crash site isn’t even close, although both the crash site and the refuge are in the Los Padres National Forest. Which isn’t to say there wasn’t a potential risk of the crash causing a fire that would threaten the habitat, or that the abandoned plane couldn’t have glided to the refuge. But neither happened.
