In a trial, if there is conflicting testimony, the jury sorts it out during deliberations, not during the trial, and certainly not during the presentation of the case. Can you imagine a witness jumping up during opening statements, shouting, “Judge, judge! I want those statements concerning me stricken from the record!” If Senator Lee’s memory of events is different today than they were at the time of his interview, then the defense should call him to the stand.

Lol, for all of that, he knew the applicable rule, and thwarted the derailment with a derailment of his own. He’s old, but he’s not an old fool. I was surprised they picked him to preside over the trial, but maybe there was a method to the madness. He could have called Senator Lee’s motion out of order—technically correct, but potentially outrageous to some Republican Senators. Instead he started putting a motion to a vote, giving the House Managers time to sort out what they wanted to do.

@30.06onaGrassyKnoll You’re letting appearances fool you. He bought the House Managers the time they needed to deal with Lee’s “objection”. Leahy could have just denied Lee’s motion as out of order—insofar as this is a trial, witnesses do not get to object to how their testimony is being characterized during the presentation phase. Instead, Leahy referred to a Senate rule to divert the objection, because it wouldn’t achieve Lee’s intended effect. This bought the House trial managers the time they needed to respond to Lee’s objection, which was to “retract without prejudice”, meaning they can try to put it back in later. The trial managers were pretty on the ball as far as recognizing the problem and heading it off, but they needed those few minutes to decide.
