They’ll get charged with the murder of the dead robber because they were committing a felony at the time he was killed.

There’s two gun cultures and it’s time we recognized and did something about it. We are people who support our second amendment right to own guns. We are sports shooters, hunters, self-defenders & home protectors, and gun enthusiasts with a healthy respect for firearms, firearm safety, and their fellow human beings. The other people in that other gun culture live in a fantasy where they are cowboys in a movie. They’re the ones that say, “I hope someone tries to break into my house.” Their sense of right and wrong boils down to: am I getting my way or not? I think people who are members of the positive gun culture understand the need to regulate emotion. We might not always be perfect, but we know that, outside of reacting to an emergency, better choices are made when the mind is calm. Being able to appropriately regulate one’s emotions is a sign of being an adult. The inability to do so is the sign of being a child.

@darbywing2 He might also be charged with lying to police, if he reported his shots fired as being fired upon. This was in the video. Guilty until proven innocent, but. Here’s the but: his defense will have to prove that the robber was already dead when he came back and shot him again, if there isn’t already absolutely clear proof of it.

I think you mean, if a defense attorney can convince a jury. But then he’d need to prove that the robber was dead beyond doubt to back that claim. The prosecution can merely show that there is no way to determine that for sure. They don’t need to prove the robber was still alive. Even if the robber was going to die shortly from his wounds, that would still be murder.

Nah, he felt fear first, and then anger as a reaction to that fear. The fear might just be a blip or it might continue longer, but it’s almost always there before the anger hits. Think back over your own experiences, or, next time you get a physical anger reaction (in a non emergency situation, of course) try to stop a moment to determine the trigger of the response. It might be a small thing, but if you’re aware of it, it can guide you to make better decisions.

@lanceschirmer5583 Interesting theory. More intelligent than a lot of commentary I’ve seen here. If you were prosecuting him, how would you prove intent?
