  4. This wasn’t an “accident”. It was the result of someone making very poor decisions: getting drunk and then getting behind the wheel. Does intentionality matter? Only a little. He’d been arrested before for DUI and was made aware of the danger to others if he drove while drunk. His reckless disregard makes this unpremeditated murder.

  7.  @Doggeslife  This wasn’t an “accident”. The perpetrator didn’t accidentally get drunk before accidentally getting in his car and accidentally turning the key. He didn’t accidentally take off the emergency brake and accidentally put his SUV into drive. He didn’t accidentally drive the SUV at a high rate of speed in what looks to be a shopping mall parking lot. He decided to do all these things, even if he didn’t set out to hurt anyone. If he had gotten a DUI conviction last year, it’s even worse because he would have been given all the information necessary to make better decisions. He made the decision to drink when he had lots of options.

  13.  @Doggeslife  yw. I hope I didn’t go overboard. You are 100% correct about gathering the evidence and following procedure. I guess my little diatribe is my “prosecutor’s argument” to a hypothetical jury wrt to the drunk driver that crashed into the Apple Store. I don’t think I’m too far out of line based on what’s being reported. I’m making a few assumptions about what happened after his previous DUI. At a minimum, he’d have gone through a diversion program that would have included education and AA meetings—probably a buttload of meetings. With regard to the kid that hit all those sheriffs deputies, he was released because they didn’t have evidence that he was DUI (at least that’s my understanding). I’ve heard that he fell asleep at the wheel. I have slightly more sympathy for that guy, having worked graveyard shift. It can really mess with you. It’s not an excuse, however. He made a bad decision.
