  1. The argument for collusion is that not in picking and not in the advice, but the “banding together” to “stay strong”. I don’t think this argument is morally right. I don’t think it’s the way the law should be interpreted. But it’s how an SEC lawyer might approach it. It’s a sufficient argument for a judge to let a lawsuit proceed. If you and your 1000 co-investors from your financial discord server get swept up, and you see what your legal fees are going to be, you’ll want to settle as quickly as possible. But maybe a crusading lawyer would take the case pro bono or at a reduced rate for the group . Who knows? I could see a young Mark Geragos jumping into something like this. Maybe even the real Mark Geragos.
