  1. He’s going to have the same problem as FDR if he tries to add justices. As things stand, he doesn’t have enough votes in the Senate, and I would bet the Dems lose control of it in 2024. I don’t enjoy the idea, but it’s a strong possibility. Thank God Chief Justice Roberts is a centrist. I’m surprised that Justice Thomas joined the majority, but not shocked: The case was decided on a procedural issue of standing.
