  1. You're not generally supposed to be able to use somebody's history against them except in narrow situations. There are exceptions to that rule, but judges generally get to decide whether or not to allow it and if they get it wrong, that can be subject to appeals court interference later on.

  2. Tamir Rice wasn't killed for having a toy gun, he was killed for waving an illegal toy gun around recklessly and then lowering it in the direction of the cops. It does nobody any good to misrepresent what happened. I was raised not to wave such toys around because it was already known that doing so could result in being shot. And I'm not even black, a white kid might have gotten a slighly longer time to wave it before being shot, but let's not pretend like a white kid can wave such a toy around and not have to worry about being shot.
