Sadly, our system does not guarantee that the attorney be competent or even awake. As long as they're a practicing attorney with the relevant membership in the bar, that's good enough. Even if they are suffering from dementia, asleep or spent 10 minutes preparing. It's barely better than nothing. We need the costs of representation to be covered by the government and paid back by the defendant if they're found guilty as part of the restitution.

There's a few issues with this, but it's completely unnecessary. If there's a conviction for DUI that caused the death, then a wrongful death case is pretty much an automatic win. The attorney wouldn't have to establish guilt, that's already been done, they'd just have to establish that their client was harmed, the children of the deceased being harmed is an incredibly easy bar to meet and the amount of the damages. That last bit is really the only one that can be tricky.
