This kind of thing happens fairly often to varying degrees. My parents recently bought a plot of land that includes a small section of logging road with an easement to a logging company, and IIRC to a public utility so they can get to their transmission lines. So, it was kind of interesting when we discovered that not only is that stretch being used for a use that doesn't appear to be covered under any of the easements, but there were signs informing us that to use the trail that we had to pay a private company to do so. I don't anticipate this being a long term issue, as the state has been pretty reasonable about the possibilities of allowing us to build a driveway over public land, I'd expect that the worst case scenario is that a land swap or set of easements are signed to give them the rights to run the trail over that stretch and for us to get a short driveway through public land. And strictly speaking, if we don't build a road, we'd be able to just drive over the land if we really wanted to. But, that's mostly because it's adults handling it and we're not standing in the way of a local politician. The property is going to be preserved for generations from any sort of major developments, and I expect that in the long run it will more or less be a continuation of the status quo where the skiers don't even know there's a driveway as it'll be covered by snow.

Just being forced to replace the tree with a similar tree can get extremely expensive, even without actual damages. Trees generally take many years to grow and are god help you if it's a sizable juniper or the like, those things can grow extremely slowly in some places.
