@Cheepchipsable I'm still watching the video, but unless the contract specifies that they aren't allowed to coordinate with each other about the overtime, then I fail to see how this isn't allowed. It doesn't sound like anybody is being forced to avoid the optional overtime and that the court is probably overstepping. Canada doesn't have slave labor, so how can these folks be forced to work if they don't want the extra time?

@nsnopper It's still "voluntary" overtime. The company doesn't haven't to allow for renegotiation if they don't want to. But, they signed a contract where the overtime was voluntary, forcing people to work when they agreed to voluntary work is still slave labor. I didn't hear anything to suggest that they weren't showing up for the hours that they were contracted to.

@dwaynepenner2788 It is, but if a business is relying on voluntary overtime, it means that the employees are taking it. And if they're taking it more than once in a while, it's probably an indication that the pay is below what it costs to live a decent life.

That's the way any reasonable person sees it. One of the issues with courts is that the judges and attorneys are often more interested in the legal theories than the reality to the actual parties in the dispute.

I think the resolution of that for the folks to show up for the "voluntary" overtime and work as carefully, and slowly, as possible. It's overtime when folks are tired, so no reason to risk injury for overtime you didn't want in the first place. I think that would probably solve the problem before too long if it takes an hour to put each piece in place as folks walk back and forth for every piece of tie wire, nut and bolt involved.

@kauinoa2004 So? The overtime is still voluntary, if nobody wants to do it, or agrees to, then they shouldn't have to do it. It's not really voluntary if they can be forced to work.
