The TSA itself is grossly unconstitutional, but they've been allowed to use the "It's consentual" justification for decades even though air travel frequently isn't optional. I had to get on a couple planes in the last couple years to go to funerals and the plane was literally the only way that I would have been able to get to the funerals. I don't think that a reasonable person would think that not going is a valid option when it comes to not wanting to be subjected to an otherwise unconstitutional search. Somehow we managed it for decades without being sexually assaulted and they haven't caught any terrorists at all in that time.
