Around here, it's only illegal if you're coming up behind a school bus that's got the sign out or are on the other side without at least one lane between you and the centerline or any kids that might be crossing. It's something that I wish more people would realize because it gets to be a minor annoyance having people stop that don't need to be stopped. The whole point of the tickets is to not hit kids that you may not see or may have limited vision to see you. If you're on the other side of the street with plenty of space, that doesn't really apply.
