@wasspj It sounds like under the technology of the day when the conviction was made, they got it right to the extent that they could. This is the result of new technology allowing for a better understanding of the evidence and to the credit of the prosecutor, there is actually an effort to right the wrong. There's a decent chance that the prosecutor doesn't just know this person is innocent, but has a decent sense of somebody else as there has been been nearly 2 decades during which DNA has been collected from numerous people that may not have even been available when the prosecution was putting together the case back then.

@Cakebattered I'm pretty sure that's not actually true. It seems like that because the US is the 3rd largest country in the world and allows people both freedom of speech to complain about alleged miscarriages of justice as well as a lot of opportunities to get things overturned on appeal. The system is far from perfect, but it's not anywhere near as common as people make you think.

@MichaelOnines Yes and that depends on what the results of the hearing is. If the judge accepts the new evidence and orders the inmate released, then changing the date won't matter. If the judge doesn't accept the evidence and they proceed, then changing it won't really matter beyond whatever relevant appeals are made. The appellate court that accepted that would likely issue their own stay on that basis.
