@docsavage4921 You don't think that it might be because he wasn't fit to stand trial? It's incredibly difficult to get that finding, and the prosecutor also gets to use their expert to verify. In less than 1% of all cases is insanity even attempted as the defense and it's pretty clear that that's a disproportionately small number of people to be mentally unfit for trial.

It probably wouldn't factor into it except perhaps during sentencing. The criminal justice system makes it incredibly hard to get off the hook for things. Even being unconscious when the crime was committed isn't a sufficient excuse to get you off the hook. You have to not understand that the crime is a crime in order to be off the hook, and even then you're stuck at a mental hospital indefinitely. Not being in control due to psychosis isn't sufficient from what I understand.
