@finris1 As a matter of law this is a real estate deal and as such is legally required to have all the agreement in writing. I get the feeling that if this was legitimately not told to her and they didn't sign it as part of the package of contracts that were signed at that time, that the title insurance company may have an issue to clean up. Or possibly malpractice on the part of the realtors involved. Not to mention the question about how all of this was allowed to happen without the home owner being notified in the first place.

@KameraShy I'm curious about what the HOA is doing if the dues for over a decade are under $2k, that's less than $200 a year and while this is likely an inexpensive part of the country to live in, $1400 probably includes interest and fines of some sort, so we're talking $100 a year which isn't a lot to work with, even when pooled with the various other owners.

TBH, for $1400 a lien being placed to cover it for collection the next time the house sells seems reasonable. I"m curious how strapped for cash the HOA is if it needs that $1400 right now.

@ms_cartographer Yes, so even if they do have to hand over whatever extra money they made, the owner is still out hundreds of thousands of dollars and likely looking at a new mortgage to pay for. It's pretty messed up all around, from the HOA that couldn't be bothered to ensure that the new owner new they were in an HOA controlled property to the local judge that must have signed off on the foreclosure without bothering to ensure that service was provided for the proceedings. I live in an HOA unit and I don't think I ever go more than a week without hearing from the HOA about something. Usually nothing huge, but it does impact somebody in the complex and it's easier for them to send it out to everybody so as to not have to worry too much about people being missed.
