I kind of feel like if you give the money back before they get to your name, that the bank might just skip it and move on. However, that doesn't mean that they necessarily won't file a criminal complaint or close your account or do something else to punish the theft. But, I doubt that they're going to bother suing if the issue is ultimately moot by the money being put back before they have enough harm to warrant a suit in federal court with so many accounts impacted by this fraud. TBH, that's probably the only silver lining that with so many people for the bank to sue to recover their funds, they may not bother with smaller accounts if the money is given back before they expend any resources trying to collect on it.

@Neodymium5312 It's not a permanent loss of voting rights typically, you can usually get the voting rights restored after completing the sentence and whatever other items are on the list that the court orders.

I used to work security in a building that had a bank branch in it and we'd have to walk through every night, however, there was one very specific hallway that we were not allowed to go down at all, it was the one with the vault at the end of it. We could see the vault, but if we went down that hall the silent alarm would go off and the cops would automatically be dispatch. I never knew exactly how far I could go down the hall without triggering it, but I never cared to find out, I just knew I could walk past the hallway and I was fine. I may have been able to step a foot a few feet in and be fine, but there was no way of knowing how close I could get without triggering the alarm.
