IMHO there's two issues, one is that the law allows them to do it, and two that they did it. At most they should have been allowed to place a lien on the property and at some point, foreclose, but at bare minimum these people should have been given whatever money back above the lien and reasonable attorney's fees for the process. As it stands, they're presumably still on the hook for any mortgage payments outstanding, even though they don't own the property and didn't get any of the proceeds from the sale.

@jimfarmer7811 I assume that the alternatives were more expensive. Around here, the property taxes and HOA dues for the condo I'm living in is less than what I'd pay for a studio apartment. If I couldn't afford this, I'd have to move quite far away.

@michaelmoorrees3585 Yes, I'm kind of curious how you have a building with multiple owners without some form of an HOA. Really, the solution is to make sure you know what the rules are for the condo and be active on the board if you see things coming that you don't like. The specific rules about what the board can do without a vote will vary a bit from place to place, but the owners can always replace the board with people that are less nuts and often are required for certain types of decisions to be made.

That's clearly not legal. While the first amendment does not apply to private companies, this would likely be an example of misappropriation and likely something that could lead to the homeowner being awarded damages. Companies cannot use your person as an endorsement without your permission.

It really depends. The building I live in has an HOA and most of the rules are pretty reasonable. But, as Steve said, you can get a new board with jerks that overstep. But, I don't have to worry about maintaining the outside of the building and I've generally got access to common areas and hardly anybody uses the pool, so it's like having my own pool. I like living in a building that's mostly quiet during the night. And that doesn't happen without some infringement on our right to make noise during the night. Then there are horror stories like this one that pop up frequently.

@machintelligence Yep, the HOA where I'm living is pretty good over all. If anything, they're overly lenient. I think the only thing that I've heard of them doing wrong was trying to lowball one of the members for black mold, which is the HOA's responsibility in the documents. It was particularly dumb as the tenant of that unit had been on the board previously and knew perfectly well that it was the HOA that was responsible for it. But, overall, I haven't seen or heard much to indicate that they even exist beyond the occasional minutes from the meetings and construction related notices. That being said, nightmare board members being elected could change that.
