Not just that, but you don't typically save any time by tailgating. You can't drive through the car ahead of you. At most you might be delayed by cars that are changing lanes in front of you.

@PhotriusPyrelus Yes, it doesn't excuse the brake check, but if you were that close, then you didn't leave enough room. A brake check isn't necessarily going to be any different from a car that has to slam on the brakes because a small child wander out from behind a parked car at the last second.

Yes, the presumption is there to discourage people from following too closely to the car ahead of them. It's not for the purpose of letting drivers brake check or cut people off with impunity. Nor does it apply if you've got broken brake lights. But, it does often times make the matter a lot faster to deal with, especially in the age of dash cameras.
