@cindydott452 I doubt very much that was an oversight. What gets me is that it's already criminal to intentionally break a condom or other barrier type of protection under battery statutes. If they were going to make stealthy specifically illegal, they should have been more expansive to other sexual activity related fraud as it pertains to pregnancey/STIs.

It's completely legitimate, the act that this law deals with was already illegal. If they wanted to pass a new law, there's no reason not to include lying about contraceptives and be done with it.

I don't see any provisions for protecting men when women lie about being on the pill. And the rest of this was already criminal.

@icicle_man4971 This was already criminal conduct. The only reason to pass this law without including lying about contraceptive use is to perpetuate the false narrative that this is something men do and women don't do.

I don't think that pointing out that women lying about birth control should have been included is at all unreasonable. If anything, that would be easier to enforce than claims of men sabotaging their condoms.

It already was, at least as far as tampering with protective barriers, that's a case where battery charges would be more appropriate.

I'm curious how they know if it was intentional without the condom. And if they have a condom to work with, then why is it being kept. I don't really like blaming the victim, but it does deserve a certain amount of explanation as to how this is actually going to be enforced and how many women are having sex with men that they think are sabotaging the condoms. Condoms break from time to time, although it isn't common.

That's simple, it doesn't include provisions for women that lie about being on other forms of contraceptive when "stealthing" was already illegal.
