  1. Because we have a legal system that's based on the notion that people are innocent until proven guilty. And you probably wouldn't like to live in a society where there isn't the presumption of innocence. As far as violent crimes go, it's not like they just get let out unmonitored.

  2. We have a legal system where the defendant is presumed to be innocent until proven guilty. It's why some defendants are allowed to be free while awaiting trial. A victim impact statement is something that the judge can consider along with the rest of the evidence when deciding whether to keep the defendant locked up or under what conditions they may be released.
