As I understand it, the basis for those class action suits is that the applicants were deprived of the application process they paid for, not that they necessarily would have gotten in. It's a much easier case to make, although not a slam dunk. With all the employees that have been caught up in this, the case may well go in favor of the plaintiffs. As they were deprived of the admissions process they were promised when they agreed to pay the applications fee.

The really dumb thing is that getting into one of those schools has little, if any, impact on how much you make in most cases. There are some situations like with legal degrees where having the right name on the degree may have an impact, but for the most part, you're flushing money down the toilet that could be better used for other things.
