  1. who makes the guns that end up on the black market jacknape? and then who sells them on the black market? dude. you think criminals just magically get guns by osmosis? they have to have them made by manufacturers whom in turn sell their guns to retailers...and who sells the guns to the black market? the RETAILERS. commercial businesses sell guns to the black market to be sold on the black market. facepalm but you know that already, right? and that's not even really addressing the issue of background checks....

  5. that's what background CHECKS are for...to check if the mental health of the person presents flags that can maybe the limit the sale of weapons to said person, maybe deny said person, given further checks and longer waiting period, i'd presume, then they could either A: get the weapon or B: they have to go through a registry. they still get the gun, but they're registered on a watch list, for a discretionary period. that helps curb guns getting into the wrong hands.
