  1. This First Amendment argument is utterly ridiculous. They are saying that if I come to you and tell you that I’m making tons of money in this real estate venture I am involved with and I convince you to give me $500,000 of your money to invest in it as well, knowing full well there is no such real estate deal and I am just going to pocket your money, I will be able to walk away with your money scot free because my false representations to you are protected by the First Amendment?? Nonsense.
