I heard both these songs before the lawsuit. I personally never made the connection. Now that the lawsuits exist, I hear the similarites by the are very clearly different songs woith a different feel

@miczell The lyrics are a part of the music, not separate. They chose Jude for a reason, not Bob. Its extremely weird to try and separate lyrics from the rest of the song. I certainly remember the lyrics of Hey Jude. In fact if we removed the "poem" completely, it wouldn't be the same song at all. It would have a completely different feel and vibe to it. You should go look into how Townsend ripped off every doo-wop artist that came before him, oh wait, he didn't. He made music in the doo-wop style. Ed Sheeran made a song in a certain style. That's all he did. No one can own a style. You can find similarities or even copy and paste parts in all genres of music. Wow, how amazing. Have you ever heard of "the lick"? Lyrics are important. You claiming they aren't is just sheer ignorance.

Everyone having their own genre is simply not realistic or mathematically possible. People are going to tell their stories in the genre they feel best for their story. That's how art works.
