The agreement was unsigned but contained exceptions for law enforcement purposes. She took the money nevertheless. Cohen violate New York law by loaning money to his client to make the payment. Daniels was in talks for a payment with media sources before accepting the payment from Cohen. Daniels not only lost her lawsuit for defamation against Trump but was ordered to pay Trump's attorney fees of $300,000. Her allegations of an affair remain unproven.

@RealAmerican666 First of a DA can usually indict a ham sandwich. Second the whole thing was basically a shakedown by Daniels that Democrats hoped to use for political purposes. Since Trump isn't a lawyer and paid for Cohen's advice he was basically insulated by Cohen and the attorney client privilege. The FEC didn't buy the original charge and Cohen who sits in a NY prisons was given immunity for his testimony is the only one who can give the prosecutor evidence that the payment was made only for campaign purposes and not to protect the President's personal reputation. Trump's first motion is anyone's guess. The DA could be asked to explain why the statute of limitations on the felony shouldn't apply. The FEC ruling could be cited as a reason to drop the charges to a misdemeanor and which would shorten the statue of limitations even further.

@RealAmerican666 Even if a woman is unfaithful it would have the same media effect as a man. For a Democrat they'd be talking about it being empowering for a women.
