  3. It had to happen at some point; I disagree with BBB! I beleive that the MT (E&W) R 1982 do allow stopping on the slip road in the event that you run out of slip road. My argument is that Subsection (4) of Section 7. allows stopping on the carriageway if the driver cannot proceed due to the presence of another vehicle on the carriageway. (It doesn't mention where that vehicle is stopped or moving). Stopping is also permited by Section 16 of the same regulations "where it is necessary for him to do so to avoid or prevent an accident". Further evidence in support of my view is that Rule 259 of the Highway Code does not mention not stopping, and none of the laws/regs that underpin Rule 271 of the Highway Code differential between a slip road and the main carriageway. Can you point to the law that says stopping on the sliproad (as opposed to the main carriageway) is not permitted?

  4. I would expect that an experienced police officer will be able to come up with a reasonable suspicion about just about anyone at any place or time. However, asking for their reasonable suspicion is good practice as it forces them to consider what their suspicion is AND whether it is reasonable. If they realise that they are on very shaky ground, many officers will change how they deal with you.

  11. This has to be a reason not to say anything until your have seen a solicitor and your replies are being recorded properly. If arrested I would hope I would say something like: “I am upset at being arrested and so I will not sure anything further until I have spoken to a solicitor.” - I have written comments on Crimebodge’s channel recommending that if the police want to arrest you, you should go quietly as the problem is never going to get sorted out on the street.

  15. There is a difference between an allegation being unproven and it being proven to be malicious. In many cases, the allegation may be unproven but clearly had some basis in fact - it was not baseless, but it was also not as serious as alleged. In other cases, where an allegation is completely baseless, the court might not be able to see any way to penalise the perpetrator without causing harm to the children, so the perpetrator goes unpunished. This does seem unfair - surely some penalty can be found that only affects the perpetrator - My suggestion would be to name and shame them in the local press.

There is no need to get married, but you need to understand the legal implications of not being married in certain situations, such as the death of your partner.

  25. So you are suggesting that it is treason to think that their might be a better way on managing the prison system than the Tories? The Tories implemented laws to ensure that more people spent more time in prison and then they didn't build any more prisons! This has the obvious result of so overcrowding the existing prisons that the prison officers could hardly retain control or have any time to undertake any rehabilitation of the prisoners. They also cut back on mental health services and provided little to no drug rehabilition services. They has to be a better way, and looking for it isn't really treasonous.

It's also part of consumer legislation that if a salesperson says that the product is suitable for certain use, and it turns out not to be, then you have a valid claim. So if the sales person tells you a bag is suitable to be used for "deep sea diving", and it turns out not to be, you will generally be entitled to a refund. I managed to return a mobile phone because the mobile provider had failed to port my old number to their new SIM. My contention was they I had been assured in the shop that they would be able to do this. My purpose in buying the phone and their phone service was, in part, to port my number to a new phone.

  28. While I agree, the issue is recalling the flow diagram when you are stopped in the street at some random point in the future. Even if you keep the flow diagram on you, you might find it difficult to consult without escalating the situation. Really the best advice is to keep the conversation pleasant with the police, and try find out: i) if you are under suspicion of an offence, in which case you will have to give your name, dob, address for indentification, ii) if they want you to account for yourself, in which case you should (only) tell them about what you have been doing, where you have been and are going and what you have on you and only do so IF you wish to (they can ask the question, but you don't have to answer), iii) if the police want to search you, in which case, you should ask them what they are looking for and why they think you have this item on you; you don't have to tell them anything but should allow yourself to be searched. Try to memorise this.

  30. No, unfortunately not. If you are in the left hand lane, and are travelling at a greater speed that the middle lane hogger, you cannot pass them on the left UNLESS their lane is congested. Normally middle lane hoggers are not travelling in congested lane; they are usually well seperated from vehicles in front and behind them, meaning it would be easy for them to see that it was safe to move into the left hand lane - but they never do!

  33.  @pootle5095  If you are suspected of an offence that is nothing to do with driving or you are supected of an indictable driving offence (such as taking the car without consent), it will be better to exit your vehicle, as the police can "do what the hell they like" to extract you, and damage to you vehicle will have because caused in the lawful execution of their duty. Generally the police will use anything you say against you, so say as little as you need to. Sometimes, admiting to a minor traffic offence can defuse the situation, possibly leading to a stern warning and nothing else. If you are behind the wheel of a car and have the keys in your possession, you are 'driving' it. The "travelling in it" arguement is spurious. I will get out of my vehicle for motoring offences I may have committed IF the police office is in danger if they try to deal with it through the window, such as on a motorway or fast dual carriageway. Ideally we would all drive to somewhere where the police can interact with us without danger to themselves, such as a service station or car park.

  36. John Lewis tried this with me on a tumble dryer that was faulty. John Lewis have also been refusing to accept Smart TVs returned under the CRA 2015 because of data protection - they say that the memory of the TVs can't be cleared of customer data by doing a factory reset on the TV, and are using this as the reason that it cannot be returned. My contention is that this is evidence that the TV is not fit for purpose. The memory must be able to be wiped, so that the TV can be returned if it is faulty. If it cannot be wiped, and this is required for a product to be returned, then it is not fit for purpose. Anyone agree?

  38. Hitting the rev limiter it unprofessional and potentially damaging as very fast acceleration can over-rev the engine before the engine management unit can do anything about it. Porsche engines count the times the revs have gone over the rev limiter, and this can devalue the car.

  40. A very good question, but sadly the answer is that they will be monitored by the existing parole officers; just not very well! A parole officer with 300 ex-offenders to supervise might find themselves having to supervise 350. This is unfair and might cause some to leave their jobs, further reducing the numbers of experienced officers.

As the video points out, should you feel the need to defend yourself, anything that you might reach for becomes an offensive weapon if you pick it up with the intention of harming someone with it, but the police and CPS will not generally prosecute you if you have picked up the first thing that came to hand and only used it with reasonable force to defend yourself; which might mean waving it about and making threats towards the attacker, using it to parying any blows they might throw at you, or hitting them with it. If you only use it enough to stop them, and not to harm them any more than is necessary to get them to stop their attack, you have a defence in law.

  50. Don' forget that in the UK, anyone can arrest anyone who is in the process of commiting an indictable (or either way) offence. BlackbeltBarrister has a video about Citizens Arrest with some valuable advice. Deciding to arrest someone when the police will not attend a crime is probably going to result a problem, if not a prosecution, as by the time you have consulted with the Police and found that they will not turn out, the crime will have been committed and the basis on which you might lawfully arrest someone is no longer valid.
