There is a difference between an allegation being unproven and it being proven to be malicious. In many cases, the allegation may be unproven but clearly had some basis in fact - it was not baseless, but it was also not as serious as alleged. In other cases, where an allegation is completely baseless, the court might not be able to see any way to penalise the perpetrator without causing harm to the children, so the perpetrator goes unpunished. This does seem unfair - surely some penalty can be found that only affects the perpetrator - My suggestion would be to name and shame them in the local press.
