You have misunderstood the advice. It was to not ignore court notices. BBB didn’t say you should respond to the scammers via email.

BBB’s channel has got a bit clickbait’y of late. The fact he missed out the consumer regulations that stop this behaviour is worrying.

Absolutely. And fraud is an Either Way offence which means you can perform a citizens arrest on anyone you think is perpetrating a fraud.

I don’t think the courts have a system to do this, and it would be relatively easy to avoid suspicion by changing your trading name on a regular basis.

Legal question: If a case came to court (in the UK), could a judge introduce the lack of the correct pre-contract information as a defence if the defendant doesn't introduce it? I would expect not, but the judge knows there is a valid defence, but the defendant doesn't, perhaps because they are representing themselves and think they can show that work wasn't done well.

If you agree to work on camera but it is shoddily or not carried out, it could be even more of a problem for you.

I wonder whether counter-claiming against them would work; e.g. to pay for engaging another contractor to remediate the work they did so shoddily? Does anyone think that this might cause then to end their court action?

Having a signature on you emails would seem to offer some protection. If the scammers want to fake an email to show you accepted a quote or agreed to them doing work, they can’t do so unless they know what your signature says. You need to protect this information until the scammer provides the court with a fake email, at which point you can provide evidence that shows it is a forgery and ask for the case to be dismissed and the claimant to be referred to the prosecuting authorities.
