  1. It's an interesting idea. The problem is that a lot of views concerning individual rights is hung up on ideals and values. These things are per definition qualitative and are therefore not subject to easy "scientific"proof. Example: I love smoking a cigaret and grabbing a beer on the weekend. I'm happy that I can do that. But you can easily argue that "scentifically" both should be banned as they are, as a whole, detrimental to health and a drain on the healthsector. How do you measure if 1 person strongly liking something weighs more/less than 2 persons who mildly dislike it? The other significant point, is that in a lot of times you could never predict the exact impact of the choices on society before the potential damage is done. Second example: Again alcohol (yeah I love beer). Prohibition was for some a good idea on paper. But it was an unmitigated disaster with regards to the rise of organized crime, and didn't do all that much to prevent alcohol consumption. Just my 2 cents
