  3. Legally speaking, yes. The question isn't really the overall morality of the encounter, but whether a security guard does himself any favors by engaging like this.

  4. again, the guard escalated the situation to that point for no reason. once the hobo didn't leave after being maced he needed to call the police, end of encounter. there was no reason for it to get to that point or for a fight to break out at all
