  5. I think a big problem is that we don’t tend to consider people’s actions from their own point of view. If the police/media had looked at Knox’s behavior in the context of what was going on, they may have seen that there was more than one possible explanation for the things she was doing.

It repeatedly states that “the media doesn’t judge a case.” That’s the ideal: that jurors obey the rule not to listen to news regarding the case they hear. But ideals and reality aren’t the same. The way the media reports on a case can always influence how jurors or a court decide. That’s why bad journalism is as much a threat to a legal system as incompetent lawyers.

She thought she was using Italian phrase for “see you later,” but it was actually the phrase for agreeing to meet someplace specific. This gave them the idea that she and Patrick met and went to the apartment. They asked her suggestive questions to that effect

  14. It shouldn’t be surprising that Italians found her behavior strange. Just consider how we as Americans have assumptions about people from foreign countries. While there was much human error involved in what happened to her, I think we also have to consider the cultural factors. Specifically, the universal human tendency not to challenge our individual assumptions.

Amanda screams and runs as Guede chases her. Meredith runs after Guede. The two girls fight Guede, he goes down, unconscious. Amanda grabs Meredith by the arm, tries to pull her towards the door - but Meredith won’t budge. Amanda: “C’mon, we have to get out of here.” Meredith: “Amanda -“ Amanda: “He might wake up! We have to get out -“ Meredith: “AMANDA! This isn’t how it happened.” Amanda: “Yes it is! I came home, we fought him, I got you out. Now come -“ Meredith: “Amanda -“ Amanda: “Don’t!” Meredith: “Amanda, you need to -“ Amanda: “NO!” (The camera focuses on Amanda’s face, which is filled with panic and terror) “No, God, please! The police decided to use the opportunity to take her into an office to be interrogated. They had probably agreed beforehand to use coercive measures because they feared she'd leave the country soon - which she should have. You can use the same methods to extract a false accusation that you can use to extract a false confession. When they found her text to Patrick, they asked suggestive questions which led her to imagine she'd heard him killing Meredith.

Within an hour of making the “accusation,” she told police that she may have been confused, asked for a pen and paper, and wrote a statement saying she wasn’t sure. After being taken to a prison cell and getting some sleep, she realized what had happened, wrote down a full recantation, and asked a guard to take it to the police. The police who interrogated her did not tape the interrogation, which they are required to do with suspects. Their excuse was that Amanda was not yet a suspect but a witness. They obviously lied, because they’d been tapping her cell phone in days leading up to the interrogation. Also, it doesn’t make sense that she’d accuse Lumumba willingly in order to deflect suspicion. If she had a part in the murder, she’d have known that Guede raped Meredith and that his DNA would be at the scene. In fact, the prosecution alleged at trial that she somehow cleaned up her own DNA and left Guede’s intentionally. Why then would she accuse a man whose DNA she would have known wouldn’t be found? If she’d wanted to deflect suspicion, she would have made the same claims, only implicating Guede and not Lumumba. It is puzzling that they’d acquit her of murder and not also of defamation. I believe that upholding the defamation conviction was political: the court didn’t want their country’s police to shoulder the full blame for the fiasco, so they put some of the blame on Amanda.

Americans have always valued individualism, seeing it as a form of responsibility in which a person takes charge of their own destiny. Italians - indeed most Europeans - have been shaped by a history based upon collectivism and shared responsibility among citizens. Therefore, it’s not surprising that Italians would conflate American individualism with selfishness.

So why not say she heard Rudy kill Meredith from the kitchen? The only reason she’d name Patrick is if she were both innocent and coerced. That amounts to circumstantial evidence and should have been enough to acquit her of slander.

That was also the reason they upheld the Calunnia conviction - they had to push some of the blame onto Amanda so it wouldn't all fall on the cops. When Raffaele applied to the government for restitution, they said he had done things to make himself appear guilty. That also shows how officials will twist facts to cover up mistakes. Why would anyone make themselves look guilty? They wouldn't! No one involved in the investigation/prosecution wants to admit that the problem was with their own perception of these two peoples' behavior.

As easy as it is to hate him, Mignini was actually a good man - Amanda herself has said this. He was present when Meredith's mother identified her daughter's body, and was determined to get the Kercher family justice. Men like Mignini are scarier than villains because their good intentions don't allow them to admit their mistakes.

They’ll take a plea for a lesser sentence because the chances of being convicted despite reasonable doubt outweighs the certainty of a lesser sentence. In the US, it’s legal for a prosecutor to say that if the defendant doesn’t take a deal immediately, it won’t be offered after the trial starts. That’s basically the same as a police officer coercing a confession.

Before the trial even starts, the prosecution has already won its case, because they have created an apparently uncontradictable argument based upon how they’ve chosen to interpret the evidence. When the jury hears the arguments, they will be inclined to believe the prosecutor, so for all practical purposes, the burden of proof is on the defense.
