Note that he was only charged with sexual assault, so the ruling only means that masturbating on a beach was, in this case, not sexual assault. Should he face charges of different nature, he might very well be convicted.

He was charged with "sexuellt ofredande" which is directly translated to "sexual molestation". Although Sweden due to strong feminist movements have relatively broad definitions of laws regarding crimes of sexual nature, this was not considered sexual molestation. As I understand it, he was was basically just sitting there masturbating and people happened to come by and see him.
