  1.  @JoaquinLomeliJr  - Your analysis is sadly shallow; I was proposing in my examples for Obama (and others) to gin up their emotions AND THEN to use the legal mechanisms provided in our framework to fight back, rather than to simply give up without a fight and accept as inevitable the depredations that others foist upon you.   2. Republicans WIN because Republicans, whatever it is, WANT IT MORE. Democrats LOSE because Democrats are more concerned with being NICE, with how they'll be seen, the OPTICS of the situation. When Moscow Mitch stole the SCOTUS seat from Obama, what did Obama do? NOTHING. Did he go to FEDERAL COURT and say, "The Constitution of the United States says that the Senate WILL Advise and Consent, and they, Constitutional officers sworn by sacred oath to uphold that Constitution, are refusing to do that". No he didn't. Did he take to the Bully pulpit and start a firestorm of public protest? He did not. For all I know, he just made a face: that was showing that mean Moscow Mitch who was the boss!!!
