When the founders wrote the constitution and the BOR, I'm sure the things they were intending to protect people from included HOAs (as well as civil asset forfeiture, of course).

@LifeLongStrong1961 At least we didn't resort to the wild wild west like the US did when it let over a million people die from Cv19.
12
As someone who doesn't like being sued, the owners of MSG sure do act peculiarly. Surely these actions are just going to increase the number of law suits against the owners.
11
@jamesodell3064 This whole thing started over a mom and pop newsletter that eBay didn't like. There's no way this will be settled.

@calanon534 You think this judge has a heart?
6
@johnpublic6582 Not really. The point being made in the OP is that these sorts of crimes are rarely punished adequately. If they were always punished adequately, it's likely that fewer people would take the risk.
6
It's not even the repair the companies are worries about. Take and old Apple product with a very simple fault into a Apple store, and they'll tell you it'll cost so much to repair, you might as well buy a new one. Then take it to a third party, who'll repair it for next to nothing.
5
It's only "breaking and entering" if you break something to gain entry. If you use an unlocked door, it's not B&E.
5
@additudeobx Do you think if your son knew the punishment would be so harsh he still would have committed the crime?
5
I bet they wouldn't be nearly as unpredictable if they passed a law saying the charges must quoted beforehand.
4
@GoldOxide8463 "The Free Market regulates itself." - which is precisely why it's "mostly unregulated".
4
@RonLarhz I didn't say it wasn't illegal, I said it wasn't breaking any entering, because it's not. What that has to do with your pickup techniques, I have no ide.
4
@christopherg2347 "Whoever holds the title is responsible for water bills." - And that's the problem here.
3
This used to happen all the time when I was at Hogwarts.
3
@TimeSurfer206 Then RICO would come into effect.
3
@GoldOxide8463 No, that's not what I said. Try again, but without the straw man.
3
@GoldOxide8463 Again, not what I said.
3
@w3vjp568 I agree, the dealers are just as big a problem as the thieves. Stick a few in jail, then see how many want to deal in stolen cats.
3
Fantastic T-Shirt, I saw a great blues band there one night in the early 80's.
2
@NathanHedglin It's very different if the owner of the house was never made aware of the HOA.
2
Surely this is libellous.
2
Switches? Burners? BBQs don't have these things. Sounds like what you had was an outdoor stove. BBQs run on wood, coal and coke. If you're BBQ uses gas, then you're not BBQing, you're just cooking outside.
2
How can a judge not know that everyone is entitled to an attorney?
2
"There's going to be gravity tomorrow" - Oh dear, the flat earthers won't like that.
2
She didn't use a phone, she used a computer which has an attached phone. When that law was written, using a "phone" meant making a phone call.
2
@akulkis what ever you say, flat earther.
2
If she had the right to see the records, then surely they can't win any action again that request. This is why people hate lawyers.
2
How can the issue of a punishment before any evidence has been presented be considered "due process"?
2
I all serious though, advertising something as zero interest, then selling them deferred interest, that certainly sounds like bait and switch to me.
2
@P_RO_ Not true for most jurisdictions, where the use of force is a requirement for B&E.
2
@Loccyster It seems implied.
2
If the previous owner had been over billed, would they have refunded the new owner? Something tells me they wouldn't have.
1
$168m. WOW. I bet that hurts.
1
Follow the truck, bring a firearm.
1
@goddessoftruth I agree. Project Varitas are demented scum.
1
Sounds like the employees from Herts who took her car have stolen it. She should have called the police.
1
Let them keep coming. Sell them on 3 bay
1
@ToddCopeland If they wanted a word that referred to anyone over the age of 14 who lived at the same age as the insured owner, then the word "driver" was a very poor choice. The word "driver" refers to someone who drives. Most 14yos do not in fact drive. As the insurance company is the lady responsible for the ambiguity, they should not benefit from the ambiguity. That's contact law 101.
1
You're not one of those nutters who thinks the 1st amendment allows you to say what ever you like, with absolutely zero consequences, are you?
1
@StephenKershaw1 I disagree. Calling any form of regulation of speech "massively unconstitutional" is just what I'd expect from someone with such beliefs. There are limits on what the first amendment does and does not allow. SCOTUS has already ruled on that. You cannot yell fire in a theatre.
1
@StephenKershaw1 thanks for the straw man fallacy sonny... I didn't say anything about hate speech, inciting terror or riot.... Further, this bill, it doesn't say anything about banning speech which contains disdain for the government. Looks like you're the one having trouble keeping up. And finished off with an ad hominem attack, how predictable.
1
@user-cr4pz5yg7y Hmmm. The threat of violence in the pursuit of political aims. Know what the founders called that? In article III Section 3, they called it treason. Today, we call that Terrorism.
1
@ripvanrevs I'd be surprised if that were legal.
1
I would say a bike is a vehicle because you can ride it on the road. Vehicles shouldn't be used in cross walks at all.
1
You can't settle with someone who wants to publicly hang you out to dry. I'd imagine someone with a newsletter might want to do just that.
1
Who would name their dog after a car?
1
"If you want to talk to a human being, put your head in your toilet and flush it with your foot."
1
I had a pocket knife with a lifetime warranty. It broke after many years. The retailer told me the lifetime in the warranty referred to the lifetime of the product, which they deemed to be over.
1
Land of the free.
1
I bought a bed once with a 10 year warranty. I broke after 6 years due primarily to a design flaw (so I imagine it wasn't the only one). When I contacted the company, they sent me a form email, explaining that the original company I bought the bed from was not longer trading, and even though the original owner had started a new company under the same name he was not responsible for making good on the repairs to the bed.
