If the seller took out finance after selling the car to you, then no, the car was not sold to you while under finance. That debt should never have been attached to the car, as it was the result of fraud. If I were to somehow trick a finance company into believing I owned your car, then take out a loan on that car, it wouldn't make you liable for the loan. I don't see how this is any different.
