Sure, the cyclist is wrong, but everyone makes mistakes on the roads, and that includes you and me. The aim is to make mistakes survivable, and preferably without injury, so the bigger picture is infrastructure and presumed liability. The road here is terribly designed - in the Netherlands this would almost certainly be segregated, keeping vulnerable road users away from lorries so that their mistakes (by any party) wouldn't matter at all. Secondly, presumed liability means that the driver's insurance would pay out in the event of a collision. Because he brings the danger to this situation, he must take far more care.
