You are partly correct when talking about ROC government but not the Taiwan territory. Taiwan was not part of the Chinese civil as it was already a separate territory not part of China. So actually Taiwan territory is not the issue here. The real issue is the China's territory which was theoretically stolen illegally by CCP-PRC from the legitimate government KMT-ROC of China.
