Second degree murder also is known as “felony murder.” It is a murder which occurs during the course of another major felony, such as a robbery, kidnapping, rape, home invasion. “Voluntary manslaughter” is when you kill someone during the heat of passion or when you kill someone’s under the mistaken impression that you are doing so in self -defense. The scenario you described is tantamount to attempted manslaughter or basic aggravated assault, not attempted second degree murder.

@6ftNaturalBeauty , you are mistaken. The law considers curbside trash as “abandoned property.” As such, the resident has no reasonable expectation of privacy in this area. For example, police detectives use “trash pulls” as an evidence technique. They can dig through curbside trash of a suspect without a warrant legally under the 4th Amendment. They test trash for DNA, search for names on utility bills, etc. At best, the Streets Department might have regulations to prohibit making a mess or littering in the process of digging through trash. The city doesn’t want people dumping trash on the sidewalk in the course of rummaging through trash for food, scrap metal, etc.
