It was illegal for him to take the documents home . It was illegal to ignore a subpoena to hand them over. It was illegal to maintain them in his possession. It is an open and shut case.

Some of the stuff he had had "TOP SECRET" stamped on it. Anyway, declassified or not, he's not allowed to have it. They tried to subpoena him for it, but he didn't return it. He can run in 2060 when he gets out of prison. He'll be 105 years old.
