This is a huge mistake on the prosecution's part. In my opinion. It's has the appearances of, lack of vigor to prosecute , while waiting on appeals courts ,to make decisions on another case that has a potential to carry on for years. And if does not turn out in prosecution's favor. Could restart this whole fiasco again. Charge him with what's clear Minnesota law now. If it does not cover it. Work with federal agencies. Then go fix or get clarification. To do otherwise is a can of worms. You legally in most states that I know of. Can't Upgrade or downgrade convictions. After a jury has given it's verdict and sentence imposed. And does Minnesota have other laws on the books to add. To add ?

This is the State's way of trying to delay and muddy the water. If your description of 3rd degree by state law is correct. Common sense would say it does not apply. Think state is afraid to hold this trial. In fear of aftermath. And what actions if any the new administration would take against "insurrection "😂

On the legal end. Having a hard time understanding why such a big deal about getting the police report. If he was arrested and charged. I would think that would be available immediately. For transparency reasons alone. By prosocuters own words. He was there. He knows what happened. So were the police. The whole point of getting the report. Is to see if there are any discrepancies. Definitely not condoning what happened. But from a legal standpoint. And transparency . By withholding this just doesn't look good. It's a document that is supposed to be an unedited statement of law enforcement after submitted. No hate mail needed. Just trying to understand the legal aspects. And why, once charged, why the defense can't get both sides of the story immediately ?
