@tyrant_tarantula I think your responding to me but I’m asking op what law he’s citing to. I’m not asking you to defend your point. I’m asking him to cite his law as a way of starting a conversation to show why he’s wrong not just that he’s wrong. I’m fully aware of the use of force policy and the laws around tasers

There was clearly a conversation before hand but he’s also not arrested for the accident but for the arguable assault with his words. You can’t make threats to am officer

A judge won’t throw it out. A jury may let them off but a judge would say the words were a threat to fight which is a crime. It’s either disorderly conduct or assault depending on how the prosecution charges it. What’s more likely is it will pled out bc this is a small crime

You don’t need to act on a threat for it to be a crime. You need to make a threat you could act on. The way the law is usally written is you intentionally or recklessly did something that could make someone fear for there safety.
