This one didn't need reasoning. A future one won't need reasoning either. They will just make something up. You have to accept that the supreme court does not decide the law. They are a political organization and they decide based on their politics and then try to find a way to justify it. The USA is also the ONLY first world country where people even know the members of their supreme court. The others are larger with far more restricted powers and members that change more often to ensure that the appointments don't become a political mess.

@iantaakalla8180 The problem is that even if it is right for the next supreme court to change all of these rulings and even though it will make the lives of most people much better it will ALSO further erode any legitimacy the court has left. We really need to reform the entire supreme court to be more like other first world countries. Most other countries have much larger courts and better methods of selecting judges along with mandatory retirement ages so that the court is much harder to make political.

It doesn't matter what legal argument you use because this isn't based on legal arguments. The court is a partisan political body. They make decisions based on politics not based on the law. They will find a way to create the outcome they want regardless of any argument you come up with.

Just accept that the supreme court is a partisan political body and it should be treated that way. I came to Germany for a PhD and I thought I would be coming back to the USA but that is not going to happen anymore. I start a job here soon and I am not coming back. It seems pretty clear the republicans want to have a theocracy and the courts will help them. I don't think it should even be legal for the government to control abortions beyond making sure they have the same safety standards as any other medical procedure and that should be under the control of the FDA.

The supreme court actually gave itself this power long ago. They where never meant to be a coequal branch of government. The legislative branch is effectively broken because of the invention of the filibuster and then later changing it to just a piece of paperwork that you file. You can have an endless filibuster and that effectively means anything requires 2/3 support so nothing gets done. The minority party also realized the the majority is blamed for not being bipartisan when that is often solely in control of the minority party. The situation is going to get a LOT worse. I don't see how we will get 2/3 democrats elected to the senate to actually get things done and the polarization will get worse. I don't think it will be long before states just start ignoring the supreme court.
