Neither case listed here used the stand you ground laws as part of their defense, it was the judge explaining the self defense laws to the jury. Not to mention both cases are quite different and really incomparable. The law itself isn't really that bad: "A person is justified in the use of deadly force and does not have a duty to retreat if: He or she reasonably believes that such force is necessary to prevent imminent death or great bodily harm to himself or herself" Sure it sounds subject to interpretation because it is and HAS TO BE. There are so many possibilities they can't be bundled into a law. Imagine if you had to retreat by law yet the pursuer is faster and has a knife at your back...what then? You have a right to self defense. It is the interpretation/application of a law in certain instances that make any law good/bad. The criminal justice system is biased, it has nothing to do with particular laws. So harping on either the law or the decision is pointless. The root is the problem, you can't cut branches off and expect a change. But part of the problem is also public perception as Dayvon points out and it really does no good ignoring the huge role media plays in it and who is actually forming it. What does the "media" say about African Americans? Gangsta thug ho bitch gat A-K bling money money money. And who is perpetuating this stereotype? African Americans. So we have the original demonization of African Americans being played out by African Americans. So yeah let's have this conversation and realize ALL parties are to blame in one way or another while most of the actual cause is rooted in the past and outside the scope of blame.
