I've never been confronted by police like that and when I go through a DUI checkpoint, I tell them straight up, No, I haven't been drinking tonight and they let me through. It's not rocket science. Just answer yes or no and follow instructions. Causing a confrontation will not make you win

  5. Mr Mackey yes it is. You can't have an open can or container of alcohol out in the public. My high school teacher got in trouble when he got pulled over for having an open box of alcohol while driving with friends.
