@jamiepatterson1214 you failed to read the situation as it is. Red car had already established merging, but cammer sped up to cut them off. Once a car has begun merging, it is your responsibility to ensure you either slow down or move over, not speed up. That's why the cammer was cited.

@erwin6395 nope. Once a car establishes control of a lane, the other drivers must yield or slow down. Red car was merging at that point but Karen wanted to play victim

@jessesmusicmanor the red car was already merging at the point of time the cammer sped up. Cammer did not brake or let the car in, which led to their citation. Police most likely determined that the red car was already establishing control of the lane before the cammer cut them off. If a car has begun to merge and you hit them, they will issue a citation to you for failing to yield.

@chrisrosenbaum26 failure to yield would have been different if the lane hadn't already merged. The lines already started to end where the car was so the cammer got cited for failing to yield. Just because you have control of a lane doesn't mean you get off Scott free unless it can be determined the other driver cut you off while they didn't start merging.

@jamiepatterson1214 well, have fun trying to prove that in court. If a car has already begun their merge aka is establishing control of the lane, then it is your responsibility to maintain a safe space. It would be a different story if the other party didn't move in

@BrandonDenny-we1rw someone who is already merging should have right of way already as they established that direction. Yes, red car shouldn't have done what they did but the cammer did nothing to prevent said accident and only escalated the situation without speeding up. If a car has already merged you can't do much but let it go. Plus there was room behind her so she could have braked and let them in instead of feeling like she owns the road

@BrandonDenny-we1rw did I say break the law? No. The courts and insurance may determine a higher liability for one of the drivers in this case. Insurance will always determine the fault based on whether the accident was preventable and who caused it. It's the job of the driver to prevent said accidents from happening to reduce liability. For example, if I was driving in the far right lane that was turning right and another driver had shown their turn signal to merge but didn't do so at last minute while I gave them plenty of opportunities to do so while maintaining a safe speed, do you think the insurance will held me or the other driver more liable?

@BartSparrow123 like I mentioned in another reply, insurance may deem more fault on her as she said there was room to merge behind her but decided to escalate the situation. Insurance will determine based on whether accident was preventable and which party failed to drive safely. I have gotten into a similar incident a few years back where a SUV had their turn signal on for a minute or two but didn't merge. I was in the far right lane which turned right in an intersection and had backed off to let them in. They didn't do anything and when I decided to speed up a little (1 or 2 mph), they merged and hit me. Their insurance claimed full responsibility since I had maintained a safe distance and didn't speed up to let them in.

@BrandonDenny-we1rw wrong. The other driver was deemed 100 percent at fault. Mind you this was on the streets, not the freeway. The road I was driving on had the far right lane turning right onto an upcoming intersection. The SUV had their turn signal on for a minute or so but didn't merge. I had slowed down as there was no traffic behind me to let them in. They kept driving straight and when I was near them, they hit my driver side, causing some paint damage and damage to the driver side mirror. Had I sped up and hit them, it may have been different.

@BrandonDenny-we1rw no but it's similar. As mentioned, the cammer may have more liability for failing to prevent an accident. Ask any lawyer and they will say the same thing.

@BrandonDenny-we1rw plus with the cammer being cited she may have more to prove on her end since she may end up paying more. If the judge reviews the evidence and determines the ticket stands, the cammer loses more than the other driver.

Tells a lot about your victim mentality and trying to blame other drivers for your problems. Seriously take the damn bus
