The Hillsborough people were warned about pursuing cases against Duckenfield and Mackrell in a criminal court.
In a Coroner's court, verdicts are arrived at on the balance of probability. In the case of Hillsborough, the court only had to be 51% certain that the victims were unlawfully killed. In a criminal court, the burden of proof is much higher. There, a jury must be certain of their verdict beyond reasonable doubt.
Duckenfield has been to court three times and has not been convicted. Duckenfield has admitted his culpability. In the name of sanity, what else is to be done?..
As far as Mackrell is concerned, the law was, and is clear. Mackrell could only be judged on the basis of Health and Safety law as it stood in 1989, not as it stood at time ofthe trial. He was found guilty and fined, in line with how the law dealt with these matters at the time of the Hillsborough tragedy. The case against Mackrell is over.
The Hillsborough people were warned, they did not heed that warning.
