It was the order by the police for Mimms to exit the vehicle after he was lawfully detained that the Supreme Court of Pennsylvania found to be in violation of Mimms' Fourth Amendment right. The court found that the officer's practice of ordering all drivers to exit their vehicles to be an illegal seizure because the officer could not show any ''objective observable facts to support a suspicion that criminal activity was afoot or that the occupants of the vehicle posed a threat to police safety.''
