One of the bedrocks of fair-use copyright, "The amount and substantiality of the portion used in relation to the copyrighted work as a whole" which there are many precedents which boil down to "without the copyrighted material, would it substantially change or alter the infringing material that was produced" ... think of it more in realm of music than vision, Without the authors named work the AI wouldn't comprehend how to produce a style in their name Same sorta deal for getty - they have more work as they'll need to produce similar evidence, ie they must hunt for clear infringements - then they'll pull a napster move, go after the people who generated the AI images first, then the weakest but big AI service (hope they don't pull a napster but i feel they will sadly, as how else will they know which AI service produced the infringing art? means to an ends...)
