To confirm with the other guy said. Actual lawyer here: suing isn't going to be a thing. There would be no basis to state a valid claim. What would hurt Jason know would be a mob of Tesla's zealots, and also companies like Tesla denying him access to their vehicles because he makes them look bad. So he has to be diplomatic when he says something negative. There are other people who make successful careers by not being diplomatic when they see something negative, but they don't usually get early access to the fancy cars.

@MoonLiteNite there's a couple of reasons. Firstly truth is an absolute defense to defamation. Secondly, he relied on their published numbers. He is clarifying their claims. He's not said their numbers are false he said that they have used them in a misleading way. They have no change in the numbers that they didn't state would overcome that fact. And for bonus third, what exactly would be the damages that they could prove. Could they demonstrate that they have even one lost sale because of this video? At most you can get somebody to give their word for it and that's hardly empirical. So in effect I think he's immune to action. If they did sue him he could probably actually get a lot of industry traction and money out of the publicity. Whereas even if they were like "yeah we did manage to squeeze an extra point one second out of there while making facially shady claims, so suck it...." That wouldn't look good on them either. It would be a terrible publicity for Tesla to argue the case and say in effect Yes the numbers we use for marketing were arranged in a way that is intentionally deceptive but we did manage to just barely live up to them.
