  30.  @stuartcrane9409  I am assuming you are earnest here. First, this information applies to the state of New York. In short, "malicious prosecution" is a tort, not a crime. Trump would have to meet all of these criteria to sue Bragg for damages: 1. There must be civil or criminal proceedings against the defendant (check). 2. Bragg must have brought or aided in the malicious prosecution (check). 3. The subject of the malicious prosecution must be decided in favor of Trump (case is not yet adjudicated). 4. Must be an ABSENCE of probable cause for Bragg to bring the charges in the first place (This guarantees Trump would never prevail in a malicious prosecution suit. His companies were found guilty of 17 felonies a few months ago, including a voluntary guilty plea from the Trump Organization CFO). 5. Malice must be proven by Trump against Bragg (I think this element might be provable). 6. Trump suffered damage as a result of the prosecution (for sure this could be proven). Every one of these elements must be present, or the suit would be dismissed before trial. In short, malicious prosecution isn't a crime, and it is impossible for Trump to prevail in civil proceedings.
